Debian is a critical position in relation to software patents: patents for software algorithms are considered as a threat to free software and an obstacle to the mission of the project to provide a completely free operating system for all. We believe that software patents do not promote innovation and encourage developers to upstream object to these patents.

Barnes and Noble declassifies list of patents Microsoft, used to put pressure on manufacturers of devices running Android
The largest U.S. booksellers Barnes and Noble, on which Microsoft sued for refusing to buy licenses for patents, allegedly infringed Nook device running Android, released some of these patents.
Licensing agreements and nondisclosure agreements are not allowed other manufacturers to other Android-devices such as HTC and Samsung share such information.

The company Dideonet claims in the South Korean court that the (unnamed) developer ffmpeg-mt and x264 illegally uses hers patent and illegally distribute the source code (meant x264 and ffmpeg-mt), affected by this patent . States that all applications using the named library, violate the patent. In the case of a positive decision on the lawsuit, the developers of ffmpeg-mt will be required to compensate Dideonet 10% of proceeds from the sale of its software products.
In Europe, the decision of the Court of Justice banned the supply of phones Samsung Galaxy S, S II, Ace because of patent infringement Apple. The ban comes into force on 15 October.
The patent, called “Managing photos on your mobile device,” describes a method for scrolling with your fingers the Gallery on the screen. Judge Brinkman also said that the decision may be reversed in case of removal of the device software that violates the patent Apple, or in case of upgrade devices to Android 3.x, where the patent is not violated.

Senior vice president and chief lawyer, David Drummond, Google (David Drummond) through an official company blog, said that Microsoft, Oracle, Apple and other companies have been organized by a hostile campaign against the Android, using bogus patents:
“They came together for patents Novell (group CPTN, which includes Microsoft and Apple) and Nortel (a group of Rockstar, which includes Microsoft and Apple), to be sure that Google will not receive these patents. They want to receive royalties of $ 15 with each device running Android. They try to make Android, we provide free, more expensive for manufacturers than Windows Phone. They are even suing Barnes & Noble, HTC, Motorola and Samsung. Patents were designed as an incentive for innovation, but now they are being used as a barrier to innovation. ”

The desire of MPEG-LA patent violations found in the format of Google WebM, seems to have led to the first success: 12 companies and organizations declared that in this format illegally used their technology. The names of these organizations are not announced, but we know that the reason for their claims – codec VP8, which copied the technology used in H.264 – the standard that is supported by MPEG-LA. According to CNET, MPEG-LA co-ordinates the actions of these organizations, which intend to form a patent pool for the collection of royalties.
MPEG-LA did not openly suggests the possibility of filing a claim, but without this it is clear that Google will make a choice between a voluntary licensing and the threat of litigation. According to the latter, WebM – free format and third-party patents, he does not break.

The Debian Project announces the release of a special document on the legal aspects and risks when dealing with software patents, aimed at training free software, and development teams distributions. The document was called “Explaining policy dissemination of proprietary solutions to the community” (Community Distribution Patent Policy FAQ) and posted on the site Debian.org.
This document was prepared by lawyers from the Center for Rights of Free Software ( Software Freedom Law Center (SFLC) ) on request and based on the information of the project Debian. The document has no legal force, but provides full information about working with proprietary solutions in software and is extremely useful for use in developing community-free distributions.
